The Prime Minister is attempting to hammer out a deal over migrant access to benefits amid fears concerns over immigration could convince votes to back exit.

Speaking in the House of Commons, Mr Gove was asked whether the government was breaking the law by allowing migrant families to be evicted without a court order.

Mr Gove said “this government would never do anything contrary to the rule of law” before adding: “But we must ensure that we safeguard our borders.

“It is an issue of profound public concern that immigration across the European Union is not being effectively controlled.

“Our Home Secretary is in the lead in taking the measures necessary to keep our borders secure and I would have thought it would have been in the interests of every citizen in the United Kingdom to stand behind her in that fight.”

Mr Gove and Mrs May are facing calls to oppose David Cameron and lead the campaign to quit the EU by Eurosceptics looking to win backing from a major Tory figure.

Mrs May said on Monday that Europe must take "urgent action" to deal with an "unprecedented migration crisis" ahead of interior ministers meeting to draw up plans to beef up border security.

The Home Secretary said: "Unfortunately, what we've had is more talk than action."
